Terms of Service

These terms apply to all orders placed with Ayesha Embroidery.
1. About these terms
Ayesha Embroidery ("we", "us", "our") is a custom embroidery and apparel-branding studio based at Unit 1, 300 Voortrekker Road, Maitland, Cape Town. By requesting a quote or placing an order with us, you agree to these terms.
2. Quotes and pricing
Quotes are based on the information you give us — your logo or design, the number of units, the placement, the embroidery size, and whether you are supplying your own garments or asking us to supply them. Quotes are valid for 14 days. Final pricing is confirmed once the design, quantities and garments are finalised, and significant changes may change the price.
3. Artwork, logos and digitising
By sending us a logo or design, you confirm that you own it or have permission to use it, and you accept responsibility for any third-party rights. Before embroidery, your design is "digitised" — converted into a stitch file the machine can read. This is a once-off fee per design, and the stitch file stays usable for your future orders of the same design.
4. Deposits and payment
A 70% deposit is required to confirm your order. This secures the digitising of your design and your place in our production schedule. Once digitising or sample work has begun, the deposit is non-refundable, as the work and costs have already been incurred. The balance is payable before collection.
5. Free sample and approval
We provide a free sample run for your approval — we do not charge for samples. Your order only goes into full production once you have approved the sample. By approving it, you confirm the design, colours, placement, spelling and finish are correct. Once a sample is approved, items that match the approved sample are not considered faulty.
6. Production and turnaround
Production typically takes 3–5 business days from the date your sample is approved and paid for, unless we agree otherwise. Turnaround times are estimates and may be affected by order size, garment availability, or factors beyond our control.
7. Customer-supplied garments
If you supply your own garments, you do so at your own risk. We take great care with every item, but we cannot accept responsibility for manufacturing faults in supplied garments, or for the occasional garment that may be damaged during the embroidery process. For larger orders we recommend supplying one or two spare garments.
8. Collection and balance
The outstanding balance must be paid in full before your order is collected or released.
9. Quality and faults
We stand behind the quality of our work. If an item has a genuine fault on our side — such as incorrect placement against the agreed brief, or a stitching defect — please tell us within 7 days of collection so we can put it right. Please see our Returns & Refunds policy for full details.
10. Cancellations
Because each order is custom-made for you, orders cannot be cancelled for a refund once digitising or production has begun, and deposits covering work already started are non-refundable.
11. Limitation of liability
To the extent permitted by law, our liability for any order is limited to repairing, replacing or refunding the affected items. We are not liable for indirect or consequential losses.
12. Your information
We use the details you provide — such as your name, contact details and logo — only to prepare your quote and complete your order. We do not sell your information.
13. Governing law
These terms are governed by the laws of South Africa, and nothing in them limits any rights you have under the Consumer Protection Act.
